By accessing or using Xomer ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Account Terms

2.1 Account Creation

• You must provide accurate and complete information
• You must be at least 18 years old to use this Service
• You are responsible for maintaining account security
• You are responsible for all activity under your account
• You must notify us immediately of any security breaches

2.2 Account Responsibilities

• One account per person or business
• Do not share account credentials
• Do not use the Service for illegal purposes
• Do not attempt to circumvent free trial limitations

3. Website Audit Authorization

3.1 Ownership and Permission

You represent and warrant that:

• You own the website(s) you submit for audit, OR
• You have explicit written permission from the website owner to audit their site
• You have the legal right to analyze and receive reports about the submitted websites

3.2 Prohibited Uses

You may NOT:

• Audit competitor websites without their permission
• Submit websites you don't own or have authorization to audit
• Use our Service for competitive intelligence gathering without proper authorization
• Scrape or systematically audit large numbers of third-party websites

3.3 Consequences of Misuse

We reserve the right to:

• Suspend or terminate accounts that violate these terms
• Delete audit results obtained through unauthorized access
• Report abuse to relevant authorities if necessary
• Pursue legal action for damages caused by misuse

4. AI Results Disclaimer

4.1 Nature of Results

Our audit results represent:

• What AI models currently know about your business (as of the audit date)
• Recommendations based on AI optimization best practices
• Opinions and suggestions, not guarantees of improvement
• A snapshot in time - AI knowledge evolves continuously

4.2 No Guarantees

We do NOT guarantee that:

• Following our recommendations will improve AI citations
• AI models will recommend your business after implementing changes
• Your AEO score will increase after website modifications
• Results will remain consistent over time (AI models update frequently)

4.3 AI Model Evolution

• AI models (GPT, Claude, Gemini, Perplexity) update regularly
• What AI knows today may change tomorrow
• Past audit results may not reflect current AI knowledge
• We recommend regular re-audits to track changes

4.4 Not Professional Advice

Xomer provides:

• Technical insights - Not legal, financial, or business consulting
• AI optimization suggestions - Not marketing strategy or SEO services
• Automated analysis - Not human expert review
• Informational content - Not professional advice tailored to your situation

5. Free Trial and Subscription Terms

5.1 Free Audit

• One free audit per visitor (enforced by hashed IP address)
• Free audit includes: full AEO report, 4 AI model analysis, top 3 action items
• No credit card required for free audit
• Free audit results expire after 30 days unless you subscribe

5.2 Paid Subscriptions

• Starter ($29/month): 1 website, monthly re-audits, full action plan
• Pro ($79/month): 5 websites, weekly re-audits, competitor tracking
• Billed monthly, auto-renewal
• Cancel anytime - no long-term contracts

5.3 Billing

• Charges occur on the same day each month
• All payments processed securely via Stripe
• Prices subject to change with 30 days notice
• No refunds for partial months

5.4 Cancellation

• Cancel anytime from your account dashboard
• Access continues until end of current billing period
• Audit history deleted 30 days after cancellation
• Can export audit data before cancelling

6. Intellectual Property

6.1 Our Property

• Xomer's audit methodology, algorithms, and scoring system are proprietary
• Service interface, design, and branding are protected by copyright
• You may not reverse-engineer, copy, or replicate our Service

6.2 Your Content

• You retain ownership of your website content and business information
• You grant us license to analyze your content for audit purposes
• We may use anonymized, aggregate data to improve our Service
• We will not share your specific audit results with third parties

7. Limitation of Liability

7.1 Service Availability

• We strive for 99.9% uptime but don't guarantee uninterrupted service
• Audits may take longer than estimated during high demand
• AI model availability depends on third-party services

7.2 Damages Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Xomer is not liable for any indirect, incidental, or consequential damages
• Total liability limited to amount paid for the Service in past 12 months
• Not liable for business losses, lost revenue, or missed opportunities
• Not responsible for actions taken based on audit recommendations

7.3 Third-Party Services

• We rely on OpenRouter for AI model access
• We use Supabase for data storage
• We cannot guarantee availability of third-party services
• Service interruptions may occur beyond our control

8. Acceptable Use Policy

You agree NOT to:

• Abuse or overload our Service infrastructure
• Attempt to access other users' accounts or data
• Use automated tools to submit excessive audit requests
• Reverse-engineer our algorithms or methodology
• Resell or redistribute our audit results
• Use the Service to harm or harass others
• Violate any applicable laws or regulations

9. Termination

9.1 By You

• Cancel subscription anytime from dashboard
• Delete account and all data via account settings

9.2 By Us

We may suspend or terminate your account if:

• You violate these Terms of Service
• You abuse the Service or harm other users
• Payment fails and you don't update billing information
• We must comply with legal requirements

9.3 Effect of Termination

• Access to Service immediately ceases
• Audit data deleted within 30 days
• No refunds for remaining subscription time
• You may request data export before termination

10. Changes to Terms

We may update these Terms of Service periodically:

• Material changes will be notified via email
• Continued use after changes constitutes acceptance
• Significant changes take effect 30 days after notice
• "Last Updated" date reflects most recent changes

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict of law principles.

11.2 Arbitration

Any disputes will be resolved through binding arbitration rather than court, except:

• Small claims court disputes
